The CLOUD Act ร— GDPR conflict isn't going away

If your customers are in the EU, where your operator is legally domiciled increasingly determines whether you can sell at all.

Storing data in "AWS Frankfurt" or "Azure Germany" doesn't make it sovereign. Under the US CLOUD Act, US authorities can compel American companies to disclose data they hold โ€” regardless of where the servers physically are. A Microsoft executive admitted this under oath before the French Senate.


European regulators noticed. In April 2026, France migrated its national Health Data Hub from Microsoft Azure to a European provider (Scaleway) for exactly this reason. The EU Cloud and AI Development Act (CADA), the SEAL sovereignty framework, and Gartner's naming of geopatriation as a top 2026 strategic trend all point in the same direction.


For an American SaaS selling into Europe, or a European company in NIS2 scope, the question is no longer "is my data in the EU?" โ€” it's "which jurisdiction can compel my operator?" That's the gap we fill.
